Selfie Paint Kits LLC (DBA Iconic Paint Party)

Introduction

These Terms of Service govern your use of the Iconic Paint Party website and services, operated by Selfie Paint Kits LLC. By accessing this website, reserving a paint party seat, or placing an order, you agree to be bound by these Terms. Continued use of the site constitutes acceptance of any updates or modifications.

Products & Services

Selfie Paint Kits offers a variety of paint-by-number experiences. Each reservation includes a prepared canvas and painting materials designed for use at a scheduled paint party event or for take-home use.

Because some of our products are custom-made from customer-provided images, additional terms regarding approvals, cancellations, and refunds apply.

Orders & Payment

All orders and reservations are subject to acceptance and availability. We reserve the right to refuse, cancel, or limit any order at our discretion.

Prices are listed in U.S. Dollars (USD) and are subject to change without notice.

Customer Approval Process

Prior to production, customers will receive a digital proof of their painting via email for review and approval.

To prevent delays, customers must approve their proof within 48 hours of receiving the approval email.

If we do not receive a response within 48 hours, the reservation will be automatically approved and production will continue.

Customers are responsible for monitoring the email address provided at checkout and ensuring they can receive communications from Selfie Paint Party.

Paint Party Reservations

We understand that plans can change.

Paint party reservations may be canceled for a full refund up to 48 hours before the scheduled event date and time.

Reservations canceled less than 48 hours before the event are not eligible for a refund. However, we are happy to offer one of the following options:

  • Transfer your reservation to a future paint party date, subject to availability.
  • Have your paint kit shipped directly to you for an additional shipping fee.

Paint kits associated with missed reservations are not eligible for refunds once the 48-hour cancellation window has passed.

Please note that we do not offer local pickup options.

At-Home Paint Kit Returns

Unopened paint kits may be returned for a refund within 7 days of the delivery date.

To qualify for a refund:

  • The paint kit must be unopened and unused.
  • All original contents must be included.
  • Return requests must be submitted within 7 days of delivery.

Customers are responsible for return shipping costs unless the return is due to an error on our part.

Refunds will be issued after the returned paint kit has been received and inspected.

Damaged or Defective Orders

If your paint kit arrives damaged, defective, or incomplete, please contact us as soon as possible.

We may request photos of the damage to assist with the claims process.

For eligible damage claims, we will:

  • File a claim with the shipping carrier on your behalf when applicable.
  • Replace damaged or missing items at no additional cost.
  • Ship a replacement paint kit if necessary.

Damage claims should be reported within 7 days of delivery to ensure the fastest resolution.

Event Changes and Cancellations

In the unlikely event that we need to reschedule or cancel a paint party, customers will be given the option to:

  • Transfer their reservation to a future event, or
  • Receive a full refund.

Damaged, Defective, or Incomplete Orders

If your order arrives damaged, defective, or incomplete, please contact us immediately at support@selfiepaintparty.com so we can review the issue and determine an appropriate resolution.

Product Use Disclaimer

Our paint kits and paint party experiences are intended for entertainment and recreational purposes. Results may vary based on individual skill level, effort, and participation. We do not guarantee specific artistic outcomes.

Intellectual Property

All content on this website, including but not limited to product designs, artwork, branding, images, text, graphics, logos, videos, and website content, is the exclusive property of Selfie Paint Kits LLC.

You may not reproduce, distribute, modify, sell, republish, or use any content without prior written permission.

User-Submitted Content

By uploading photos, images, or other content, you represent that you own the content or have permission to use it.

You grant Selfie Paint Kits LLC a limited license to use the submitted content solely for the purpose of creating, producing, and fulfilling your order.

Customers are responsible for ensuring they have the legal right to submit any uploaded image.

Photography, Video Recording & Promotional Use

Selfie Paint Party events may be photographed, recorded, livestreamed, or otherwise documented for marketing, advertising, promotional, educational, and business purposes.

By purchasing a reservation, attending an event, or participating in a Selfie Paint Party experience, you grant Selfie Paint Kits LLC, its affiliates, employees, contractors, and representatives permission to capture and use your name, image, likeness, voice, artwork, completed paintings, video recordings, photographs, testimonials, and other content created or captured during the event.

You acknowledge and agree that such content may be used, edited, reproduced, published, displayed, distributed, and shared in any media format, including but not limited to websites, social media platforms, advertisements, promotional materials, email marketing, printed materials, and future marketing campaigns.

You understand that you will not receive compensation, royalties, ownership rights, or additional notice regarding the use of such content.

If you do not wish to appear in promotional content, you must notify Selfie Paint Party in writing prior to attending the event. While we will make reasonable efforts to accommodate such requests, we cannot guarantee exclusion from all group photos, videos, livestreams, or event recordings.

Attendance at a Selfie Paint Party event constitutes your consent to the collection and use of such content as described in this section.

Company Rights

We reserve the right to update product offerings, event schedules, pricing, policies, website content, and service availability at any time without prior notice.

Shipping & Carrier Responsibility

For orders that require shipping, once an order has been shipped, Selfie Paint Kits LLC is not responsible for delays, damage, or loss caused by shipping carriers. However, we will make reasonable efforts to assist customers in resolving shipping-related issues.

SMS/MMS Marketing Program

By opting into our SMS/MMS marketing program, you consent to receive recurring automated promotional and transactional messages.

  • Message and data rates may apply.

  • To opt out, reply STOP, END, CANCEL, UNSUBSCRIBE, or QUIT.

Limitation of Liability

To the fullest extent permitted by law, Selfie Paint Kits LLC shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from the use of our website, services, events, or products.

Dispute Resolution

Any dispute arising from the use of this website, participation in a Selfie Paint Party event, or purchase of our products shall be resolved through binding arbitration in Oklahoma City, Oklahoma, in accordance with the rules of the American Arbitration Association.

Class actions and representative claims are not permitted.

Governing Law

These Terms shall be governed and interpreted in accordance with the laws of the State of Oklahoma, without regard to conflict of law principles.
